Standard rights under the Residential Tenancies Act

These protections apply to every tenancy in New Zealand and cannot be contracted out of, regardless of what is written into special terms.

  • Quiet enjoyment

    The tenant has exclusive, quiet use of the premises. The landlord (or tradespeople) must give at least 48 hours' notice before entering for inspections or maintenance, and 24 hours for repairs.

  • Healthy Homes Standards

    The landlord must comply with the Healthy Homes Standards for heating, insulation, ventilation, moisture/drainage and draught stopping.

  • Maintenance & repairs

    The landlord must keep the premises in a reasonable state of repair and respond to urgent repairs (loss of essential services, serious safety issues) without delay.

  • Bond

    Bond is capped at 4 weeks' rent and must be lodged with Tenancy Services within 23 working days of receipt. The landlord can only deduct from bond for proven damage, unpaid rent or cleaning beyond fair wear and tear.

  • Rent increases

    Rent can only be increased once every 12 months and the landlord must give at least 60 days' written notice.

  • Ending the tenancy

    Periodic tenancies require 90 days' notice from the landlord (or 42 days for specific reasons) and 28 days from the tenant. Fixed-term tenancies end on the agreed date unless both parties agree to extend.

  • Tenant liability

    A tenant's liability for careless damage is capped at the lesser of 4 weeks' rent or the landlord's insurance excess (RTA s49B). The tenant is fully liable for intentional damage.

  • Privacy

    The landlord may only collect personal information that is necessary to manage the tenancy and must store it securely.
