Terms of Service

1. Acceptance of terms

By accessing or using KLYR, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the service. These terms apply to all visitors, users, and others who access or use the service.

2. About KLYR

KLYR is a property-health management tool designed for New Zealand landlords and tenants. It provides incident reporting, maintenance tracking, inspection scheduling, and shared property logbooks. KLYR is operated by Ashley Sutherland and Anjali Sehgal ("we", "us", "our"), trading as KLYR.

3. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms.

4. Accounts and eligibility

To use KLYR, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information, and keep it up to date. You must be at least 16 years old to use the service.

5. Acceptable use

You agree not to misuse the service. Prohibited conduct includes:

  • Using the service for any unlawful purpose or in violation of New Zealand law.
  • Submitting false, misleading, defamatory, or harassing content.
  • Uploading content you do not have the right to share, or that infringes another person's privacy or intellectual property.
  • Attempting to access accounts, properties, or data that are not yours.
  • Reverse-engineering, scraping, overloading, or interfering with the security or operation of KLYR.
  • Introducing malware, viruses, or any other harmful code.

6. Intellectual property

KLYR and its original content, features, and functionality are and will remain the exclusive property of KLYR and its licensors. The service is protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable licence to use the service for its intended purpose.

7. Payment and subscriptions

Some features of KLYR require a paid subscription. All payments are processed by Paddle. Subscription fees are billed in advance on a recurring basis. You authorise us to charge your payment method on file. Prices are subject to change with reasonable notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

8. Suspension and termination

We may suspend or terminate your account, without prior notice or liability, for any reason, including: material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the service will immediately cease.

9. Disclaimer of warranties

KLYR is provided "as is" and "as available", without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, KLYR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the service. Our total aggregate liability is limited to the amount you paid to KLYR in the 12 months before the event giving rise to the claim, or NZ$100, whichever is greater.

11. Indemnity

You agree to indemnify and hold harmless KLYR and its team from any claims, losses, or costs arising from your use of the service, your content, or your breach of these terms.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new terms on this page with an updated date. Your continued use of the service after such changes constitutes acceptance of the revised terms.
